This case returns following our remand to reconstruct the record in Texas Workers’ Compensation Commission Appeal No. 010961, decided June 20, 2001. A contested case hearing was held on remand on July 11, 2001. With respect to the issue before him, the hearing officer determined that the respondent (claimant) is entitled to supplemental income benefits (SIBs) for the 17th quarter. In its appeal, the appellant (carrier) argues that the hearing officer’s determinations that the claimant made a good faith effort to look for work during the qualifying period for the 17th quarter, that his unemployment during the qualifying period is a direct result of his impairment from the compensable injury, and that he is entitled to SIBs for the 17th quarter are against the great weight of the evidence. The appeals file does not contain a response to the carrier’s appeal from the claimant.
DECISION
The hearing officer’s decision and order are final pursuant to Section 410.204(c).
In his decision, the hearing officer states that the claimant’s cross-examination and redirect examination were reconstructed in accordance with our remand instructions. However, although the audiotapes that were forwarded with the exhibits are identified as being the tapes for this case, they are not the tapes from either the April 7, 2001, hearing or the July 11, 2001, hearing on remand. In accordance with Section 410.203(c), we are without the authority to remand a case more than once. Because the audiotape record of the claimant’s cross-examination and redirect examination are not available, we cannot review the record and issue a decision in this case within the period of our continuing jurisdiction. Accordingly, the hearing officer’s decision became final in accordance with Section 410.204(c).
