This appeal arises pursuant to the Texas Workers’ Compensation Act, TEX. LAB. CODE ANN. § 401.001 et seq. (1989 Act). A contested case hearing was held on January 2, 2002. The hearing officer resolved the disputed issues by deciding that the appellant (claimant) did not sustain a compensable injury on _______________, and that he thus had no resulting disability. The hearing officer further determined that the respondent (carrier) did timely contest the compensability of the reported injury in accordance with Section 409.021. The claimant appealed the hearing officer’s determinations on sufficiency grounds, and also alleged that the hearing officer showed bias and prejudice in disregarding the claimant’s evidence. The carrier responded, urging affirmance.
DECISION
Affirmed.
The hearing officer did not err in determining that the claimant did not sustain a compensable injury nor have resulting disability. Further, the hearing officer did not err in determining that the carrier timely disputed the compensability of the claimant’s alleged injury. The parties presented conflicting evidence regarding each issue. The hearing officer is the sole judge of the weight and credibility of the evidence. Section 410.165(a). We conclude that the hearing officer’s decision is supported by sufficient evidence and that it is not so against the great weight and preponderance of the evidence as to be clearly wrong and unjust. Cain v. Bain, 709 S.W.2d 175 (Tex. 1986).
With respect to the claimant’s allegation that the hearing officer showed bias or prejudice toward him, we have reviewed the entirety of the record and find no evidence of the hearing officer demonstrating bias or prejudice to either party.
The hearing officer’s decision and order are affirmed.
