This appeal arises pursuant to the Texas Workers’ Compensation Act, TEX. LAB. CODE ANN. § 401.001 et seq. (1989 Act). A contested case hearing (CCH) was held on February 20, 2002. The hearing officer resolved the issues before him by determining that the respondent (claimant) sustained a compensable injury on ________, and as a result of her injury had disability for the period beginning September 8, 2001, and continuing through the date of the CCH. The appellant (carrier), seeking reversal, appealed on sufficiency grounds. The claimant responded, urging affirmance.
DECISION
Affirmed.
The hearing officer did not err in determining that the claimant sustained a compensable injury on ________. The hearing officer wrote that he found the claimant’s testimony regarding her mechanism and extent of injury credible, and that he believed the medical evidence supported her claim. The hearing officer is the sole judge of the weight and the credibility to be given the evidence. Section 410.165(a). Upon our review of the record, we conclude that the hearing officer’s determination that the claimant sustained a compensable injury on ________, is supported by the evidence, and that it is not so against the great weight and preponderance of the evidence as to be clearly wrong or manifestly unjust. Cain v. Bain, 709 S.W.2d 175, 176 (Tex. 1986); Texas Workers’ Compensation Commission Appeal No. 001360, decided July 27, 2000.
We likewise affirm the hearing officer’s determination that the claimant had disability from September 8, 2001, through the date of the CCH, February 20, 2002. The claimant’s testimony together with many doctors’ decisions to take the claimant off work entirely as a result of her compensable injury support the hearing officer’s determination. See Section 401.011(16).
The hearing officer’s decision and order are affirmed.
