This appeal arises pursuant to the Texas Workers’ Compensation Act, TEX. LAB. CODE ANN. § 401.001 et seq. (1989 Act). A contested case hearing was held on November 1, 2002. The hearing officer determined that (1) appellant (claimant) did not sustain a compensable repetitive trauma injury; (2) claimant did not have disability; (3) claimant did not timely report his injury and did not have good cause for reporting the alleged injury after the 30-day period; (4) claimant did not have good cause for late filing of his claim; and (5) the date of injury was ____________, as stipulated. Except for the determination regarding date of injury, claimant appealed these determinations on sufficiency grounds. Respondent self-insured (carrier) responded that the Appeals Panel should affirm the hearing officer’s decision and order.
DECISION
We affirm.
We have reviewed the complained-of determinations regarding injury, timely filing of a claim, and timely notice and conclude that the issues involved fact questions for the hearing officer. The hearing officer reviewed the record and decided what facts were established. We conclude that the hearing officer’s determinations are supported by the record and are not so against the great weight and preponderance of the evidence as to be clearly wrong or manifestly unjust. Cain v. Bain, 709 S.W.2d 175, 176 (Tex. 1986). Regarding disability, there can be no disability without a compensable injury. Texas Workers’ Compensation Commission Appeal No. 000037, decided February 18, 2000. With regard to timely filing of a claim, we note that the fact that claimant did not know of the requirement is no excuse for failing to timely file a claim. Texas Workers’ Compensation Commission Appeal No. 001919, decided September 19, 2000.
We affirm the hearing officer’s decision and order.
