This appeal arises pursuant to the Texas Workers’ Compensation Act, TEX. LAB. CODE ANN. § 401.001 et seq. (1989 Act). A contested case hearing was held on March 11, 2003. The hearing officer resolved the disputed issues by deciding that the date of injury is ____________; that the respondent (claimant) did not sustain a compensable injury in the form of an occupational disease while working for the employer because he did not timely report his injury to the employer; and that he did not have disability. The appellant (carrier) filed an appeal conditioned on the claimant filing an appeal. The appeal file does not contain an appeal from the claimant, nor a response to the carrier’s appeal.

DECISION

The hearing officer’s decision and order have become final. Section 410.169.

The carrier filed an appeal conditioned upon the filing of an appeal by the claimant. The claimant did not appeal the hearing officer’s decision and order. Accordingly, we dismiss the carrier’s appeal.
