This appeal arises pursuant to the Texas Workers' Compensation Act, TEX. LAB. CODE ANN. § 401.001 et seq. (1989 Act). A contested case hearing was held on September 9, 2004. The hearing officer resolved the disputed issues by deciding that the respondent (claimant) is entitled to supplemental income benefits (SIBs) for the third quarter, June 4 through September 2, 2004. The appellant (carrier) conditionally appeals the determination of SIBs entitlement for the third quarter. The claimant responds, urging affirmance.

DECISION

The hearing officer’s decision and order have become final. Section 410.169.

The carrier’s request for review stated that if the Texas Workers’ Compensation Commission (Commission) records reflect an approval of settlement, then the carrier withdraws its request for review. Commission records reflect an approval of settlement, therefore, the carrier’s request for review has been withdrawn and the hearing officer’s decision and order have become final.
