The Magistrate for the United States District Court, Northern District of Texas, recommended dismissal of Plaintiffs’ claims against the State defendants in their official capacities pursuant to the Eleventh Amendment and dismissal of the remaining claims against all defendants for failure to state a claim upon which relief can be granted. The Court noted that pro se plaintiffs ordinarily should be granted leave to amend their complaint prior to dismissal. However, because the Plaintiffs' claims were fatally infirm, the Court concluded that granting leave to amend would be futile and cause needless delay.
