The Appeals Panel reversed the hearing officer’s determination that the employer and carrier had actual notice of the claimant’s occupational disease and rendered a decision that neither had timely notice of the right carpal tunnel syndrome. Because the claimant failed, without good cause, to timely notify the employer of the injury and there was no actual knowledge, the carrier and employer were relieved of liability for medical and income benefits. The Panel affirmed the unappealed findings that the claimant sustained a compensable occupational disease and had disability, but those findings did not result in benefit liability due to the notice failure.
