This appeal arises pursuant to the Texas Workers’ Compensation Act, TEX. LAB. CODE ANN. § 401.001 et seq. (1989 Act). A contested case hearing was held on April 12, 2002. The hearing officer determined that appellant (claimant) did not sustain a compensable injury and that he did not have disability. Claimant appealed these determinations on sufficiency grounds. The appeals file does not contain a response from respondent (carrier).
DECISION
We affirm.
We have reviewed the complained-of determinations and conclude that the issues involved fact questions for the hearing officer. The hearing officer reviewed the record and decided what facts were established. We conclude that the hearing officer’s determinations are not so against the great weight and preponderance of the evidence as to be clearly wrong or manifestly unjust. Cain v. Bain, 709 S.W.2d 175, 176 (Tex. 1986).
We note that we will not generally consider evidence not submitted into the record, and raised for the first time on appeal. Texas Workers’ Compensation Commission Appeal No. 92255, decided July 27, 1992. We have reviewed the evidence claimant attached to his brief and conclude that it does not meet the standard for consideration for the first time on appeal. Black v. Wills, 758 S.W.2d 809 (Tex. App.-Dallas 1988, no writ). We have also reviewed claimant’s complaints about the alleged misstatements of the evidence and we perceive no reversible error. We also note that there were no issues in this case regarding relief from liability due to intoxication.
We affirm the hearing officer’s decision and order.
